On June 20, 1945, the Presidency of the Montenegrin Anti-Fascist Assembly of People's Liberation issued a Decision on the establishment of five district prosecutor's offices in Montenegro, and among others, the District Public Prosecutor's Office in Berane was formed for the territories of the municipalities of Berane (then Ivangrad), Rožaje, Andrijevica and Plav, while in 1947 the District Public Prosecutor's Office was established in Berane (then Ivangrad) for the area of ​​jurisdiction of the District Court in Beranam. After that, according to the Law on Public Prosecutions (Official Gazette of FNRJ 7/1965), the District Public Prosecutor's Office in Berane continued its work as the Municipal Public Prosecutor's Office in Berane, and after the reorganization of the judicial bodies in the sixties of the last century, the District Public Prosecutor's Office from Ivangrada was moved to Bijelo Polje.Also, according to the Law on Public Prosecution in Montenegro from 1975, the Municipal Public Prosecutor's Office in Berane continued its work until the passing of the Law on Public Prosecution from 1990, when it was renamed the Municipal Public Prosecutor's Office in Berane.

The Constitution of Montenegro stipulates that the State Prosecutor's Office is a unique and independent body that carries out the tasks of prosecuting perpetrators of criminal offenses and other punishable offenses that are prosecuted ex officio, and that the affairs of the State Prosecutor's Office are carried out by the heads of state prosecution offices and state prosecutors, while the State Prosecutor's Office regulates the organization and competence of the State Prosecutor's Office, the organization of the work of state prosecutors' offices, the composition, election, mandate, organization and manner of work of the Prosecutor's Council, as well as other matters of importance for the work of the State Prosecutor's Office and the Prosecutor's Council.

In this regard, the State Prosecutor's Office performs its function on the basis of the Constitution, laws and confirmed international treaties, and that the Basic State Prosecutor's Office is established for the area of ​​one or more basic courts, so the Basic State Prosecutor's Office in Berane was established for the area of ​​the Basic Court in Berane, and that court was established for the territories of the municipalities of Berane, Andrijevica and Petnjica.
