Jurisdiction of the Prosecutorial Council
The Prosecutor's Council ensures the independence of the State Prosecutor's Office. The Supreme State Prosecutor presides over the Prosecutor's Council, except in disciplinary proceedings. The composition, election, mandate, organization and way of working of the Prosecutor's Council are regulated by law.
PROSECUTORIAL COUNCIL
- determines the proposal for the election of the Supreme State Prosecutor;
- elects and dismisses heads of state prosecution offices and state prosecutors;
- determines the termination of the function of heads of state prosecution offices and state prosecutors;
- proposes to the Government the amount of funds for the work of the State Prosecutor's Office;
- submits to the Assembly the annual report on the work of the State Prosecutor's Office;
- performs other tasks established by law.
Competences of the Prosecutor's Council (Article 37 Law on the State Prosecutor's Office, "Official Gazette of Montenegro", No. 11/2015 and 42/2015)
The Prosecutor's Council, in addition to the competences established by the Constitution:
- determines the number of state prosecutors;
- determines the proposal for the dismissal of the supreme state prosecutor;
- decides on the disciplinary responsibility of state prosecutors and heads of state prosecution offices;
- takes care of the education of state prosecutors and heads of state prosecution offices;
- ensures the use, functionality and uniformity of the Judicial Information System in the part related to the State Prosecutor's Office;
- keeps records of data on state prosecutors and heads of state prosecution offices;
- adopts the rules of procedure of the Prosecutor's Council;
- gives an opinion on the incompatibility of the performance of certain tasks with the performance of the prosecutorial function;
- reviews the complaints of state prosecutors and heads of state prosecution offices and takes positions regarding threats to their independence;
- reviews complaints about the work of state prosecutors and heads of state prosecution offices regarding the legality of their work;
- forms the Commission for the Evaluation of State Prosecutors;
- elects a disciplinary prosecutor;
- determines the methodology for preparing reports on the work of the State Prosecutor's Office and the annual work schedule;
- issues official identification cards to state prosecutors and heads of state prosecution offices and keeps records of official identification cards;
- performs other tasks established by law.
Secretariat of the Prosecutorial Council
Secretariat of the Prosecutorial Council
Pursuant to Article 167 of the Law on State ("Official Gazette of Montenegro", Official Gazette of Montenegro, No. 11/15, 42/15, 80/17, 10/18, 76/20, 59/21 and 54/24)), the Secretariat of the Prosecutor's Council (hereinafter: the Secretariat) was established for the professional performance of professional, financial, administrative, IT, analytical and other tasks Prosecutor's Council and affairs of common interest for all state prosecutor's offices.
Bearing in mind the need to implement measures to strengthen the administrative capacity of the Secretariat of the Prosecutorial Council, in order for the Prosecutorial Council to perform its responsibilities more efficiently, the need for adopting a new Rulebook on the internal organization and systematization of the Secretariat of the Prosecutorial Council emerged.
Based on Article 171 paragraph 2 of the Law on the State Prosecutor's Office ("Official Gazette of Montenegro", number 11/15, 42/15, 80/17, 10/18, 76/20, 59/21 and 54/24), on the proposal of the secretary of the Secretariat of the Prosecutorial Council, the Prosecutorial Council adopted the Rulebook on the internal organization and systematization of the Secretariat on December 20, 2024. of the Prosecutor's Council, which entered into force on December 30, 2024.
In the Secretariat of the Prosecutor's Council, in accordance with the aforementioned Rulebook, 5 organizational units are foreseen, namely:
- Department for professional support in the work of the Prosecutor's Council,
- Service for information - communication technologies and multimedia,
- Service for general and personnel affairs,
- Accounting and Finance Department,
- Public Procurement Service.
