Jurisdiction
The Higher State Prosecutor's Office in Podgorica is responsible for:
- for proceeding before the High Court in Podgorica in criminal proceedings instituted due to criminal offenses for which, as the main punishment, a prison sentence of more than ten years is prescribed;
- in criminal proceedings for criminal offences:
- murder at random,
- rape,
- endangering air traffic safety,
- unauthorized production, possession and distribution of narcotic drugs,
- calling for a violent change in the constitutional order,
- disclosure of secret information,
- causing national, racial and religious hatred, discord and intolerance,
- violation of territorial sovereignty,
- association for unconstitutional activities,
- preparation of acts against the constitutional order and security of Montenegro,
- against humanity and other goods protected by international law.
In addition, the Higher State Prosecutor's Office in Podgorica is responsible for:
- for conducting financial investigations;
- in appeal procedures against criminal decisions of basic courts;
- decides on complaints that require a review of the decision on the rejection of criminal charges by the basic state prosecutor's offices;
- resolves the conflict of competences between the basic state prosecutor's offices in their area,
- performs international legal assistance in criminal matters.
